Terms of Service

These terms are between Berkshire Valley Group LLC (“we”) and the business using Gonia (“you”). Creating an account or using the platform means you accept them.

1. What Gonia is

Gonia is a customer relationship management platform. It holds your contacts, schedules appointments, tracks your work, and sends messages to the people you choose — through channels you connect yourself.

2. Your account

  • Give accurate details when you sign up, and keep your sign-in credentials to yourself.
  • You can invite people to your organization and give them roles. What they do with your organization’s data is your responsibility.
  • Gonia is for business use, by someone old enough to enter a contract where they live.

3. Your data, and your customers’ data

The contacts, appointments, messages and files you put into Gonia are yours. We hold and process them so the platform can work, and we act on your instruction.

For the people in your CRM, you decide what is collected and why. Having a lawful reason to hold their details, and answering their questions about it, is your responsibility — not ours. Our privacy policy sets out what the platform itself does with that data.

Before you send anyone marketing you must have their consent, and you must honour it when they withdraw it.

4. Sending messages

  • Messages leave through channels you connect: your own WhatsApp Business account and your own mail server. We do not message anyone on our own behalf, and we do not relay your messages through a sending identity of ours.
  • If you connect WhatsApp, Meta’s own terms for the WhatsApp Business Platform apply to you directly, alongside these.
  • The platform enforces some of this for you and will refuse to send when the recipient has not consented or has opted out, when the message falls inside your quiet hours, or when you are sending marketing over the WhatsApp Cloud API without a working inbound webhook — because without one, a customer’s “STOP” cannot reach us.
  • If your hard-failure or unsubscribe rate crosses a platform threshold we may pause your marketing automatically until you have looked at your list. Transactional messages — booking confirmations, reminders — keep going.

5. Acceptable use

Do not use Gonia to send unlawful, deceptive or harassing content, to message people who have not agreed to hear from you, to try to reach another organization’s data, or to resell access to the platform.

6. Plans, limits and fees

Plans and their limits are listed on our pricing page, and the platform enforces those limits.

Gonia does not process payments. There is no checkout in the app and no card is ever stored — a subscription is arranged with us directly and paid outside the platform, and support is handled personally. Automatic billing is planned; we will not move you onto it without telling you first.

7. Suspension

We may pause your marketing automatically for the list-health reason in section 4, and we may suspend or close an account that breaches these terms. Where we can, we will tell you why.

8. Ending your use of Gonia

You can stop using Gonia whenever you like, and ask us to delete your data — the data deletion page explains how.

We may end these terms by giving you reasonable notice, except where a breach means we have to act sooner.

9. No warranty

Gonia is provided as is. We do not promise it will be uninterrupted or free of errors, and we cannot promise that a message you send will arrive — delivery depends on Meta, on mail providers, and on the recipient.

10. Limitation of liability

So far as the law allows, we are not liable for lost profits, lost data, or indirect or consequential loss. Our total liability for any claim relating to Gonia is limited to what you paid us in the twelve months before the claim.

11. Changes to these terms

If these terms change we update the date at the top. Carrying on using Gonia after a change means you accept it.

12. Governing law

These terms are governed by the laws of the State of Florida, USA.
